U.S. Supreme Court Ruling Preserves FDA Authority
Patient and provider groups applaud the Court’s unanimous decision to protect patients by reaffirming the FDA’s authority.
WASHINGTON, DC (June 13, 2024) – The Arthritis Foundation, on behalf of the nearly 60 million adults living with arthritis in the U.S., applauds the U.S. Supreme Court’s unanimous decision to reverse the Fifth Circuit Court’s decision in Alliance for Hippocratic Medicine et al. v FDA et al. Today’s ruling reaffirms the authority of the Food and Drug Administration (FDA) to make critical decisions about drug safety, efficacy and conditions of use.
Generations of people living with arthritis and others with serious, chronic conditions have trusted the FDA’s expertise, which is based on a rigorous science- and evidence-based review process to ensure that medications are safe and effective. These medications are often life-changing.
The Arthritis Foundation, along with several patient and provider organizations, filed an amicus brief to highlight how the court’s decision may affect patients and why it is important to preserve the FDA’s authority in the drug approval process.
The Supreme Court’s decision is a significant win for patients. It ensures that the FDA remains in charge of approving safe and effective medications, reinforcing that experts in science and medicine are best suited for these decisions and protecting patients from potential judicial interference.
We strongly support the FDA’s role in safeguarding patients and unequivocally commend the Supreme Court for preserving this authority and upholding an institution that is critical to Americans having access to the care they need.
